Protecting the customer's privacy when processing personal data is an important concern for EVOC Sports.

Personal Data
Personal data is data related to the customer's person. Personal data processed by EVOC Sports may include the customer's user ID in the Apple AppStore or Google PlayStore as well as a unique, pseudonymized ID generated from it, provided the customer's log in to the EVOC App with the customer's user ID. If the customer does not log in to the EVOC App, EVOC Sports does not process any personal data.
Data related to the Use of the EVOC App
Currently, advertising identifiers are used to create usage profiles in apps from EVOC Sports. EVOC Sports receive statistics directly from the App Store or Google Play Store and from the EVOC App's own admin tool.
Security
EVOC Sports has taken necessary technical and administrative security measures to protect the customer's personal data against loss, destruction, manipulation, and unauthorized access. All EVOC Sports employees and service providers working for EVOC Sports are bound by the applicable data protection laws.
Whenever EVOC Sports collects and process personal data, it is encrypted before being transmitted. This means that the customer's data cannot be misused by third parties. EVOC Sports security measures are subject to a continuous improvement process, and the privacy statements from EVOC Sports are constantly revised. The customer has to ensure to have the latest version.
The customer's Information according to Art. 13 GDPR
1. What data is processed and from what sources does this data originate?
EVOC Sports processes the data EVOC Sports receives from the customer in the context of contract initiation or execution or based on the customer's consent:
- Personal data (see above)
- Data related to the use of the app (see above)
2. For what purposes and on what legal basis is the data processed?
EVOC Sports processes the customer's data in accordance with the provisions of the General Data Protection Regulation (GDPR) and the Federal Data Protection Act 2018 in its current version: for the fulfillment of (pre-)contractual obligations (Art 6 Para. 1lit.b GDPR):
The processing of the customer's data is carried out for contract execution online or in one of branches in which EVOC Sports operates, for contract execution in the company. The data is processed in particular during the initiation and execution of contracts with the customer.
3. Processing of personal data for advertising purposes
EVOC Sports does not use the data EVOC Sports receives in connection with the use of the EVOC App for advertising purposes.
4. Who receives the customer's data?
If EVOC Sports uses a service provider in the sense of order processing, EVOC Sports still remains responsible for protecting the customer's data. All order processors are contractually obliged to treat the customer's data confidentially and only to process it within the scope of service provision. The order processors commissioned by EVOC Sports receive the customer's data if they need the data to perform their respective services. These are, for example, IT service providers that EVOC Sports needs for the operation and security of EVOC Sports IT system. If there is a legal obligation or a court order, authorized state authorities and institutions can be recipients of the customer's data.
5. How long will the customer's data be stored?
EVOC Sports process the customer's data until the end of the business relationship or until the expiry of the applicable statutory retention periods (such as the Commercial Code, the Tax Code); beyond that until the end of any legal disputes in which the data is needed as evidence.
6. Will personal data be transferred to a third country?
As a matter of principle, EVOC Sports does not transfer any data to a third country. A transfer takes place in individual cases only on the basis of an adequacy decision by the European Commission, standard contractual clauses, appropriate guarantees, or the customer's explicit consent.
7. What data protection rights do the customer has?
The customer has the right at any time to information, correction, deletion, or restriction of the processing of his stored data, a right to object to the processing as well as a right to data portability and to lodge a complaint in accordance with the conditions of data protection law.
Right to Information:
The customer can request information from EVOC Sports as to whether and to what extent EVOC Sports processes the customer's data.
Right to Correction:
If EVOC Sports processes the customer's data that is incomplete or incorrect, the customer can request its correction or completion at any time.
Right to Deletion:
The customer can request the deletion of his data from EVOC Sports if EVOC Sports processes it unlawfully or if the processing disproportionately interferes with the customer's legitimate protection interests. There may be reasons that prevent immediate deletion, e.g., in the case of legally regulated retention obligations. Regardless of the customer's right to deletion, EVOC Sports will immediately and completely delete the customer's data as long as there is no legal or contractual retention obligation in this regard.
Right to Restriction of Processing:
The customer can request the restriction of the processing of his data from EVOC Sports if
- the customer disputes the accuracy of the data, for a period that allows EVOC Sports to verify the accuracy of the data.
- the processing of the data is unlawful, but the customer refuses deletion and instead request restriction of data usage,
- EVOC Sports no longer need the data for the intended purpose, but the customer needs this data for the assertion or defense of legal claims, or
- the customer has lodged an objection to the processing of the data.
Right to Data Portability:
The customer can request that EVOC Sports provides him with his data, which the customer has provided to EVOC Sports, in a structured, commonly used, and machine-readable format and that the customer transmits this data to another controller without hindrance from EVOC Sports, provided that
- EVOC Sports processes this data based on the customer's given and revocable consent or for the fulfillment of a contract between EVOC Sports, and
- this processing is carried out using automated procedures.
Where technically feasible, the customer can request a direct transfer of his data from EVOC Sports to another controller.
Right to Object:
If EVOC Sports processes the customer's data out of legitimate interest, the customer can object to this data processing at any time; this would also apply to profiling based on these provisions. EVOC Sports will then no longer process the customer's data unless EVOC Sports can demonstrate compelling legitimate grounds for the processing that override the customer's interests, rights, and freedoms, or the processing serves the assertion, exercise, or defense of legal claims. The customer can object to the processing of his data for direct marketing purposes at any time without giving reasons.
Right to Lodge a Complaint
If the customer believe that EVOC Sports is violating German or European data protection law when processing his data, EVOC Sports asks the customer to contact EVOC Sports to clarify any questions. Of course, the customer also has the right to contact the supervisory authority responsible for him, the respective State Office for Data Protection Supervision.

8. Is the Customer obliged to provide Data?
The processing of the customer's data is required to fully use all functionalities of the EVOC App. By registering within the app, the customer commits to providing the data. The customer can refuse this registration or delete it at any time.
Changes to this Privacy Policy
EVOC Sports reserves the right to change EVOC Sports privacy statements if this becomes necessary due to new technologies. The customer has to ensure to use the latest version.
